Bail conditions imposed by some judges are outrageous-Justice Kulendi

A Justice of Ghana’s apex Court, Justice Emmanuel Yoni Kulendi has described conditions given by some judges in granting bail to accused persons as outrageous.

He also bemoaned the practice where judges keep suspects on remand in police and prison custody when those suspects could have been granted bail.

“A judge can grant bail in the sum of GHc100, 000 with three sureties, two to be justified and two of them must be civil servants. Which law says that one has to be a civil servant to bail an accused person?” he quizzed.

Speaking at the introduction of media ambassadors for a Ghana Case Tracking System (GCTS) on October 21, 2021 in Accra, Justice Kulendi further revealed that he had made a suggestion to the Judicial Service to cause the arrest of such judges who unnecessarily remand suspects so they will feel the conditions of the conditions of accused persons on remand.

“If judges have that experience and other human beings are standing in front of them, they would understand what it takes to be on remand,” he noted.

The Ghana Case Tracking system (GCTS) is an integrated case tracking, information and notification system that allows the major players in Ghana’s criminal justice system to keep track of the status of criminal cases from the Police Station until the Courts make a final determination.

It will enhance transparency in the criminal justice system by dealing with the issue of missing dockets.

The Ghana Police Service, Judicial Service, Prison’s service, The AG’s Department, National Investigations Bureau (NIB) and the Legal id Commission are institutions utilizing this system.

Additionally, Justice Kulendi indicated the practice of keeping accused persons on remand for several years contrary to the Constitutional provision that one is presumed innocent until proven guilty, is fundamentally wrong.

Moreover, he said that such condition should only be for criminals but not accused persons.

Furthermore, the SC Justice admitted that keeping some accused persons on remand for longer periods, is an indictment on Ghana’s Criminal Justice system.

“Let’s make only those who must be kept in prison be in prison. If a person has not been found guilty, he should not be needlessly be remanded,” he concluded.
